Fax marketing compliance
In Australia, all marketing faxes sent must comply with the Telecommunications (Fax Marketing) Industry Standard and the Do Not Call Register.
When sending marketing or unsolicited faxes it is important to ensure you comply with the applicable legislation in the recipient’s destination country. Marketing faxes sent in Australia are governed by the following legislations:
Telecommunications (Fax Marketing) Industry Standard
The Telecommunications (Fax Marketing) Industry Standard 2021 applies to all faxes made to Australian numbers that:
- Offer, advertise or promote goods, services, land, interests in land, business opportunities or investment opportunities
- Advertise or promote suppliers or prospective suppliers of such things
- Solicit donations
- Conduct opinion polling or standard questionnaire-based research.
The standard establishes minimum enforceable requirements for those sending unsolicited faxes in the following four areas.
- Allowable times for sending faxes
- Information to be provided on a fax
- Opt-out facility
- Limit on number of faxes to be sent to a recipient in a period.

Do Not Call Register
When sending unsolicited 'marketing' faxes to Australian fax numbers, you must check (or ‘wash’) your number lists against the Do Not Call Register (DNCR).
- if the number is on the register, you must not send faxes to this number
- if the number isn't on the register, you can send faxes, however you must follow the above 4 requirements as per the Telecommunications (Fax Marketing) Industry Standard 2021.
